Your privacy is very important to us. Please read below to see how KWINDOO handles information. Before you get to the details, here are a few of our fundamental privacy principles:

  • Information you upload or post to KWINDOO may be seen by others depending on your privacy settings.
  • We aggregate and de-identify certain information about our members to use for business purposes.
  • We give you several ways to control the privacy of your personal information and are continuously working to enhance privacy options available to you.

KWINDOO respects your privacy and shares your concern about the security of information you may submit to KWINDOO’s websites and the related mobile applications and services (collectively, the “Services”). Our privacy policy (the “Privacy Policy”) explains the information we collect, how we use and share it, how to manage your privacy settings and your rights in connection with the Services. Please also read the Terms of Service which sets out the terms governing the Services.

KWINDOO is headquartered in Hungary and our Services are provided to you by KWINDOO ltd. If you are a resident of the European Union (“EU”), KWINDOO Ltd.  is the controller of your personal data for the purposes of EU data protection law.

This policy was written in English. To any extent a translated version conflicts with the English version, the English version controls. Unless indicated otherwise, this Privacy Policy does not apply to third party products or services or the practices of companies that we do not own or control, including other companies you might interact with on or through the Services.

We Collect, Use, Share and Otherwise Process Information

KWINDOO relies on a number of legal bases to collect, use, share, and otherwise process the information we have about you for the purposes described in this Privacy Policy, including:

  • as necessary to provide the Services and fulfill our obligations pursuant to the Terms of Service. For example, we cannot provide the Services unless we collect and use your location information;
  • where you have consented to the processing, which you can revoke at any time. For example, you may consent to the processing of GPS related information;
  • where necessary to comply with a legal obligation, a court order, or to exercise and defend legal claims;
  • to protect your vital interests, or those of others, such as in the case of emergencies;
  • where you have made the information public;
  • where necessary in the public interest; and
  • where necessary for the purposes of KWINDOO’s or a third party’s legitimate interests, such as those of visitors, members or partners.

Our Legitimate Interests

We process your information in furtherance of our legitimate interests, including:

  • providing and improving the Services, including any personalized Services. We do so as it is necessary to pursue our legitimate interests of providing and developing innovative and tailored offerings to our members on a sustained basis; and
  • keeping the Services safe and secure. We do so as it is necessary to pursue the legitimate interests of KWINDOO and its members in ensuring the Services are secure, and to protect against fraud, spam and abuse, etc.

Information KWINDOO Collects

KWINDOO collects information about you, including information that directly or indirectly identifies you, if you or your other members choose to share it with KWINDOO. We receive information in a few different ways, including when you track, complete or upload activities using the Services. KWINDOO also collects information about how you use the Services. There are also several opportunities for you to share information about yourself and your activities with KWINDOO. For example:

  • We collect basic account information such as your name, email address, and password that helps secure and provide you with access to our Services.
  • Profile and use information is collected about you when you choose to upload a picture, activity (including date, time and geo-location information as well as your speed and performance) or post, join a challenge, add your equipment usage, view others’ activities, or otherwise use the Services.
  • You may choose to add your contacts’ information to connect with your contacts on KWINDOO and to send them your activity information while using KWINDOO. If you choose to use these features, KWINDOO will access and store your contacts’ information in accordance with your instructions. By submitting such contact information, you confirm that you have the authority to use and share such information. (no such service currently)
  • KWINDOO collects information from devices and apps you connect to KWINDOO. (note: this function is not yet impemented)  For example, you may connect your external hardware account to KWINDOO and information from these devices and apps will be passed along to KWINDOO.(not in use now)
  • KWINDOO may collect or infer performance information which may include speed, dierction, location information. Before you can upload information to KWINDOO or information from which KWINDOO can get information, you must give your explicit consent to the processing of that information by KWINDOO. You can withdraw your consent to KWINDOO processing your information at any time. Write to [email protected].
  • We may gather information from the photos, posts, comments, notes and other content you share on the Services, including when you participate in partner events or create segments or routes, tracks.
  • When you make a payment on KWINDOO, you may provide payment information such as your payment card or other payment details. We use Payment Card Industry compliant third-party payment services and we do not store your credit card information. (KWINDOO ID free and no such paying feature available at present!)
  • We collect and process location information when you sign up for and use the Services. To record your performance and to provide you with your statistics and inclusion in the Service’s features (for example, the leaderboard for a route), it is necessary to collect and record the physical location of your device including, data such as speed and direction. Processing of your location data is essential to the Services which we provide and a necessary part of our performance of the agreement we have with you.
  • KWINDOO allows you to sign up and log in to the Services using accounts you create with third-party products and services, such as Facebook or Google (the latter not available at this time)  (collectively, “Third-Party Accounts”). If you access the Services with Third-Party Accounts we will collect information that you have agreed to make available such as your name, email address, profile information and preferences with the applicable Third-Party Account. This information is collected by the Third-Party Account provider and is provided to KWINDOO under their privacy policies. You can generally control the information that we receive from these sources using the privacy settings in your Third-Party Account.
  • To help us to provide you with the best possible service, you can choose to provide us with your contact information so we can better respond to your support requests and comments. (no such feature at this time)
  • We may collect information from your browser, computer, or mobile device, which provide us with technical information when you access or use the Services. This technical information includes device and network information, cookies, log files and analytics information.

Cookies and Similar Technologies

When you visit the Services, a cookie will be stored on your computer. Generally, cookies and similar technologies work by assigning to your browser or device a unique number that has no meaning outside of KWINDOO. KWINDOO uses these technologies to personalize your experience and to assist in delivering content specific to your interests. Additionally, after you’ve entered your member ID (email) and password during a session on the Services, KWINDOO saves that information so you don’t have to re-enter it repeatedly during that session.

Most browsers automatically accept cookies. To manage the collection of information through cookies or other equivalent technology you can use the settings on your browser or mobile device. KWINDOO is committed to providing you choices to manage your privacy and sharing. However, KWINDOO does not recognize or respond to browser-initiated Do Not Track signals, as the internet industry has not fully developed Do Not Track standards, implementations and solutions. To learn more about Do Not Track signals, you can visit https://allaboutdnt.com. Not accepting cookies may make certain features of the Services unavailable to you. KWINDOO may also use your IP address to identify you, to administer the Services and to assist in diagnosing problems with KWINDOO’s servers.

Log Files

The Services use log files. Stored information includes IP addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks. This information is used to analyze trends, administer, protect and secure the Services, track member movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc., may be linked to session IDs, athlete IDs and device identifiers.

How KWINDOO Uses Information

KWINDOO uses the information we collect and receive to administer and operate the Services and as otherwise described in this Privacy Policy. For example, we use performance information to provide you with statistics and visualizations representing key data on your achievements. Subject to your privacy settings, your information, including your profile, username, photos, members you may follow and who follow you, clubs you belong to, your activities, and notes and comments you give and receive will be shared on KWINDOO to participate in the Services, for example to show your place on a leaderboard. Location information, such as a route or segment may also be shared on KWINDOO (in accordance with your settings).

We also use your information to analyze, develop and improve the Services. To do this, KWINDOO may use third party analytics providers to gain insights into how our Services are used and to help us improve the Services. We may also use your information to market the Services, credit or accept payments, provide support related to the Services, protect members and enforce our Terms of Service, promote safety, and communicate with you. Additionally, your information may be shared with third parties, as set forth below.

KWINDOO may de-identify or aggregate the content you make available in connection with the Services, in ways that do not personally identify you. Examples of such aggregated information or statistical data include information about equipment, usage, demographics, routes and performance. KWINDOO may use, sell, license, and share this information with third parties for research, business or other purposes such as to improve performance via KWINDOO. KWINDOO also uses aggregated data to generate our overall heatmap. (not yet imlemented) Please visit your privacy settings if you object to KWINDOO using your information for these purposes.

We use your information to communicate with you about the Services, send you marketing communications (where you have agreed to receive such messages), or let you know about new features or updates to our Terms of Service. We also use your information to respond to you when you contact us. KWINDOO will use your information to communicate with you, for example by sending you notifications.

How Information is Shared

Service Providers

We may share your information with third parties who provide services to KWINDOO such as supporting and improving the Services, promoting the Services, processing payments, or fulfilling orders. (not applicable at this time) These service providers will only have access to the information necessary to perform these limited functions on our behalf and are required to protect and secure your information. We may also engage service providers to collect information about your use of the Services over time on our behalf so that we or they may promote KWINDOO or display information that may be relevant to your interests on the Services or other websites or services.

Publicly Available Information

Subject to your privacy settings, your information and content may be publicly accessible.

Third Party Business via API or Other Integrations

When you choose to use third party apps, plug-ins, or websites that integrate with the Services, they may receive your information and content, including your personal information, photos, and your activity data (including private activities). Information collected by these third parties is subject to their terms and policies. KWINDOO is not responsible for the terms or policies of third parties.

Affiliates and Acquirors of our Business or Assets

We may share your information with affiliates under common control with us, who are required to comply with the terms of this Privacy Policy with regard to your information. If KWINDOO becomes involved in a business combination, securities offering, bankruptcy, reorganization, dissolution or other similar transaction, we may share or transfer your information in connection with such transaction.

Legal Requirements

We may preserve and share your information with third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your country of residence, if we determine that such disclosure is reasonably necessary to comply with the law, including to respond to court orders, warrants, subpoenas, or other legal or regulatory process. We may also retain, preserve or disclose your information if we determine that disclosure is reasonably necessary or appropriate to prevent any person from death or serious bodily injury, to address issues of national security or other issues of public importance, to prevent or detect violations of our Terms of Service or fraud or abuse of KWINDOO or its members, or to protect our operations or our property or other legal rights, including by disclosure to our legal counsel and other consultants and third parties in connection with actual or potential litigation.

DMCA Notices

We may share your information with third parties when we forward Digital Millennium Copyright Act (DMCA) notifications, which will be forwarded as submitted to us without any deletions.

How We Protect Information

We take several measures to safeguard the collection, transmission and storage of the data we collect. Although we strive to employ reasonable protections for your information that are appropriate to its sensitivity, we do not guarantee or warrant the security of the information you share with us and we are not responsible for the theft, destruction, loss or inadvertent disclosure of your information or content. No system is 100% secure. The Services uses industry standard Secure Sockets Layer (SSL) technology to allow for the encryption of personal information and credit card numbers, if applicable. KWINDOO engages only companies which are industry leaders in online security and Services verification to strengthen the security of KWINDOO’s Services. The Services are registered with site identification authorities so that your browser can confirm KWINDOO’s identity before any personally identifiable information is sent. In addition, KWINDOO’s secure servers protect this information using advanced firewall technology.

To help ensure that these measures are effective in preventing unauthorized access to your private information, you should be aware of the security features available to you through your browser. You should use a security-enabled browser to submit your credit card information and other personal information at the Services. Please note that if you do not use a SSL-capable browser, you are at risk for having data intercepted.

Most browsers have the ability to notify you if you change between secure and insecure communications, receive invalid services identification information for the Services you are communicating with, or send information over an unsecured connection. KWINDOO recommends that you enable these browser functions to help ensure that your communications are secure. You can also monitor the URL of the services you are visiting (secure URLs begin with https:// rather than http://), along with the security symbol of your browser to help identify when you are communicating with a secure server. You can also view the details of the security certificate of the services to which you are connected. Please check the validity of any Services you connect to using secure communications.

While KWINDOO continues to work hard to protect your personal information, no data transmission over the Internet can be guaranteed to be absolutely secure, and KWINDOO cannot ensure or warrant the security of any information you transmit to KWINDOO. Transmitting personal information is done at your own risk.

Managing Your Settings

Privacy Settings

KWINDOO offers several features and settings to help you manage your privacy and how you share your activities. Most privacy settings are located in your privacy settings page, but some may be specific to individual activities. KWINDOO provides you the option to make your activities private. To manage your privacy settings, please visit relevant sites at KWINDOO or in your mobile apps.

Adjust Notification and Email Preferences

KWINDOO offers various ways to manage the notifications you receive. You can choose to stop receiving certain emails and notifications by indicating your preference at KWINDOO.com or in your apps. You may also unsubscribe by following the instructions contained at the bottom of each type of email.

Updating Account Information

You may correct, amend or update profile or account information that is inaccurate at any time by adjusting that information in your account settings. If you need further assistance, please contact KWINDOO az [email protected]. WINDOO will generally respond to your request within 7-10 business days.

Deleting Information and Accounts

You may request that your account is deleted by contacting [email protected] Once deleted, your data, including your account, activities and place on leaderboards cannot be reinstated and will be lost for you.mYour public profile may be displayed in search engine results, if any,-  until the search engine refreshes its cache.

EU Members’ Rights

If you are habitually located in the European Union, you have the right to access, rectify, download or erase your information, as well as the right to restrict and object to certain processing of your information. While some of these rights apply generally, certain rights apply only in certain limited circumstances. We describe these rights below:

  • Access and Porting

You can access much of your information by logging into your account. If you require additional access or if you are not a KWINDOO member, contact us at [email protected]. To download a copy of your data please reqest at [email protected].

  • Rectify, Restrict, Limit, Delete

You may also rectify, restrict, limit or delete much of your information by logging into your account. If you are unable to do this, please contact us at [email protected].  KWINDOO will generally respond to your request within 10-14 business days.

  • Object

Where we process your information based on our legitimate interests explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons.

  • Revoke consent

Where you have previously provided your consent, such as to permit us to process data about you, you have the right to withdraw your consent to the processing of your information at any time. For example, you can withdraw your consent by updating your settings. In certain cases, we may continue to process your information after you have withdrawn consent if we have a legal basis to do so or if your withdrawal of consent was limited to certain processing activities.

  • Complain

Should you wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local supervisory authority.

Transfers

The Services are operated from the Europen Union. If you are located outside of the European Union and choose to use the Services or provide information to us, you acknowledge and understand that your information will be transferred, processed and stored in the European Union as it is necessary to provide the Services and perform the Terms of Service.

Retention of Information

We retain information as long as it is necessary to provide the Services to you and others, subject to any legal obligations to further retain such information. Information associated with your account will generally be kept until it is no longer necessary to provide the Services or until you ask us to delete it or your account is deleted whichever comes first. For example, where you withdraw your consent to KWINDOO processing your information, KWINDOO will delete all related information you uploaded. Following your deletion of your account, it may take up to 30 days to fully delete your personal information and system logs from our systems. Additionally, we may retain information from deleted accounts to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the Terms of Service and take other actions permitted by law. The information we retain will be handled in accordance with this Privacy Policy.

Information about you that is no longer necessary and relevant to provide our Services may be de-identified and aggregated with other non-personal data to provide insights which are commercially valuable to KWINDOO, such as statistics of the use of the Services. For example, we may retain publicly available segments or routes and other depersonalized geolocation information to continue to improve the Services and to use in KWINDOO. This information will be de-associated with your name and other identifiers.

Other KWINDOO Sites

KWINDOO maintains certain websites that can be accessed outside of https://KWINDOO.com, or Other Sites. The Other Sites maintain the look and feel of the Services, but are hosted by outside service providers with their own terms and privacy policies. If you interact with the Other Sites, your information may be stored, processed, or shared outside of the Services. If you interact with the Other Sites, you acknowledge that you may be subject to the terms and conditions and policies applicable to such Other Site. Please be aware that any personal information you submit to the Other Sites may be read, collected, or used by other users of these forums indefinitely, and could be used to send you unsolicited messages. KWINDOO is not responsible for the personal information you choose to submit via the Other Sites.

Advertising campaigns

KWINDOO allows advertisers to run ad campaigns on the Services.

The information and advertisements that you see when accessing the Services may or may not be targeted on the basis of your current KWINDOO activity, such as your current location, your destination or contextual information based on your current tracking session.

Depending on your settings, you may also see ads personalized to you based on:

  • Information we received from you eg. boat class.
  • Past activity and routes
  • Information from our ad partners, including entities that belong to the Google group of companies and other trusted ad partners.

Please note:

  • We don’t knowingly collect nor do we show you personalized ads based on sensitive categories, such as race, religion, sexual orientation, or health, these information are not available for us and we do not consider these in any way.
  • We don’t share information that personally identifies you with advertisers, such as your name or email, unless you specifically ask us to. For example, if you see an ad for a nearby boat shop and select the “tap to call” button, we’ll connect your call and share your phone number with the boat shop, if that service is vailable at that time. Currently not.
  • As described under “When KWINDOO shares your information” section above, we work with other Google’s services for our performance measurement purposes. (Advertising ID available on Android mobile devices or similar technologies). You can learn more about how Google uses information from sites or apps that use its services and how you can control that in this page.
  • When you visit a third party website from KWINDOO, such third party may use cookies on your computer. The third party’s use of cookies is subject to their own privacy policies and not to this Privacy Policy. If you wish to study the privacy policies of those third parties you should visit their services, or contact them directly.

The Services includes an internal messaging system which provides you the ability to receive messages from us only. You hereby agree that we may use the internal messaging system for the purpose of informing you regarding events, happening related to your racing or outside the direct scope but which may interest you.

Please note however that other KWINDOO users are not allowed and cannot use your contact details or our internal messaging account for messaging or definitely not for commercial advertising purposes. If you have encountered any user generated advertising material, please inform us through at [email protected]

It is clarified that we are not responsible for the contents of individual profiles and any contents that may be advertisement related or suggets advertisements. In you notice such please inform at [email protected]

 

Privacy Policy Information

KWINDOO reserves the right to modify this Privacy Policy at any time. Please review it occasionally. If KWINDOO makes changes to this Privacy Policy, the updated Privacy Policy will be posted on the Services in a timely manner and, if we make material changes, we will provide a prominent notice. If you object to any of the changes to this Privacy Policy, you should stop using the Services and delete your account.

PRIVACY POLICY BEFORE GDPR:

We, at KWINDOO, respect your privacy. This policy explains the privacy practices of KWINDOO ("KWINDOO") on www.kwindoo.com (our "Website") and with respect to KWINDOO's mobile applications “KWINDOO Application") (collectively referred to as "the Services"). It describes how KWINDOO collects and uses your personal information and the rights and options available to you.

This policy is incorporated into and coherent part of KWINDOO’s Terms and EULA (the "Terms and EULA" or the "Terms").

By using our Services, you acknowledge that the Terms and this Privacy Policy constitute a binding and enforceable legal contract between the Company and the person connecting to, accessing or using KWINDOO.

In this policy, the term 'personal information', or 'personally identifiable information' (PI or PII) means any information that, with reasonable efforts, may be used to identify you, such as a first and family name, home or permanent residence address and email address.

PERSONAL INFORMATION THAT YOU PROVIDE

When you register with the Services, KWINDOO may ask you to provide certain contact and personal details, such as mobile device number and e-mail address. Note that false, incorrect, or outdated information may hinder KWINDOO to provide you with the Services and to contact you should that be required.

Yo may be required to provide further information when KWINDOO exchange communications with you, e.g. if you submit a request, contact KWINDOO for support or report a violation case.

PERSONAL INFORMATION THAT YOU SHARE

The Services are based on users' locations and submissions, including user submissions made to third party services (such as social networks) which interact with the Service upon such users' choice, all of which may include personal information. You may upload and share content with other users on social media. The content that you share over social media should be treated as neither private nor confidential and you should not have any expectation of privacy with respect to it. Therefore, you must exercise caution and common sense when submitting information. At the very least you should demonstrate the same degree of caution as when publishing personal information by means other than the Internet and cellular services. KWINDOO may make certain content that you submit for posting viewable to all Internet users.

In any event (but except as detailed below with respect to information shared from your social network accounts according to your privacy settings for such social network accounts), your email address or mobile device number will not be visible to others through any reports or user posts that you share or upload.

We, at KWINDOO, take great measures to provide you with the best experience you can have while using the Service; However, KWINDOO has no control over the conduct of any user, and disclaims all liability in this regard. Users are advised to carefully and thoroughly consider whether or not to make public or available any information and carefully examine all necessary details related to any communication with other users prior to any engagement or communication being made.

Participating in any user's activities as a result, directly or indirectly, from using KWINDOO, is entirely at your own risk. KWINDOO is not a party to any agreement entered into between the users in any circumstances. The user has the sole and ultimate responsibility regarding compliance with all laws, regulation or any other duty. We do not accept any liability for any loss, damage, cost or expense that you may suffer or incur as a result of or in connection with your participation in any activity or event initiated, held or conducted by a user or a third party nor in connection to any agreement between the users or third parties, including any activity or event related in any way, directly or indirectly, the Services or the use thereof.

LOCATION BASED AND SENSOR INFORMATION WE COLLECT

When you use your mobile device with a copy of the Application installed, KWINDOO collects your location and possibly some of your device-sensors' information. KWINDOO uses that information to provide you and other users with the Services. KWINDOO may make use of your location and/or sensor information to create aggregated anonymous data and to use such data in accordance with this policy (please refer to the use of aggregated information chapter hereunder). KWINDOO will make reasonable efforts to permanently remove or obscure your identity from your location or sensor information that is used for aggregated purposes or outside the scope of KWINDOO's services.

OPTING OUT OF LOCATION AND SENSOR INFORMATION SERVICES BY UNINSTALLING THE APPLICATION OR CHANGING SETTINGS

Any time you may uninstall the Application, by using the Application's uninstall option, or by using the programs removal feature of your operating system. Following the uninstallation process, KWINDOO will not be able to collect any further location or sensor information from you.

You may change how much and how often information is shared by the app by using the Application’s internal settings, whenever available. There is no obligation to share any sensor or location information with us, and all location and sensor information shared with us is therefore with the consent of the user and governed by the terms of the “aggregated information” section hereunder.

INTEGRATION WITH SOCIAL NETWORKS

You may choose to share information between the Application and your social network account (e.g. Facebook, Twitter). Through this option, you may choose to have personal information and other content about you available from social networks, transmitted and shared through the Services. Similarly, you may choose to have personal information and other content about you available from KWINDOO, including your location and submitted network information, transmitted to and shared through your social network account.

The social network's use of information made available by KWINDOO is governed by that social network's privacy policy and controlled by the social network, not by this Policy or KWINDOO.

When you connect to the social network account through the Services for the first time or otherwise make the Services interact with your social network account, you will be asked to permit the social network to share your personal information stored on such social network with the Services. We collect your information from your social networks account only in accordance with your privacy settings you have set up under your social networks accounts. Accordingly we only collect such information which you allowed the social network(s) to share with third parties (such as your name, email address, list of friends, profile picture, other information you make publicly available via the applicable social network and/or other information you authorize us to access by authorizing the social network to provide such information) subject to the privacy settings that you have set in such social network accounts.

META-DATA THAT WE COLLECT

KWINDOO collects information about the use of the Services. For example, KWINDOO may record the frequency and scope of your use of the Services, the duration of your sessions, the web pages that you visit, information that you read, content that you use or create, advertisements that you view or click on, your communications with other users and third parties, the Internet protocol (IP) address and the name of the domain that serve you to access the Services, and the geographic location of the computer system that you are using to log-in. Such data is usually automatically collected and stored in log files of the Services' computer servers.

WHAT DOES KWINDOO DO WITH YOUR PERSONALLY IDENTIFIABLE INFORMATION?

KWINDOO may use your personally identifiable information for the following purposes only:
to operate the Services and to improve and customize your experience with the Services, as well as the experience of other users;
to provide you with support and handle request and complaints;
to send you updates, notices, announcements, and additional information related to the Services;
to send you marketing and advertising material through e-mail messages, subject to your prior indication of consent. At any time you may opt out of the Services' mailing lists, by changing your preferences in your personal account or by sending KWINDOO a written notice to [email protected] In any case, KWINDOO will not knowingly share your personal identifiable details with any advertisers, without your explicit consent;
to conduct surveys and questionnaires;
to enforce the Terms;
